Contract Management provides participants with a practical insight into the nature of contract law and professional liability, applied to various types of projects and workplace situations.
This course seeks to identify and emphasise each of the phases and situations that arise in the contract management process to better manage and control business outcomes. In addition, current topical issues such as dispute/partnering/issue resolution and compensation for negotiations and tender submissions are addressed. The various roles of significant players in contracts will be discussed and techniques highlighted to assist best practice in the handling of contracts.

Managerial law environmental framework – the construct
This section provides in-depth knowledge into the legal system who oversees the making and breaking of contracts. You will be given an overview on the Australian court structure and it’s constitution as well as key players in the legal system and it’s procedures.

Ever wondered where or how a contract first came about? Where it originated and why? Look no further. This section answers all that as well as provide elements of the contract from terms, types, breach and discharge.
Partnering
Partnering is not to be confused with or regarded as a contract. It can be seen as a component of or an implied characteristic of a contract. Here, partnering will be explored and dissected and differentiated with a contract. You will learn the benefits of partnering, advantages and disadvantages and it’s impact.
Dispute management
Alternative Dispute Resolution (ADR) is a popular choice to resolve disputes, avoiding the hassle of court battles and costs. This section is devoted to the issue of ADR, detailing what it is and why it is used and the processes involved. It provides a comprehensive view on the system and various dispute resolution methods.
Specification
Essentially, the specification details any relevant information needed to take on a task. This should be written clearly and succinctly and should be understood by any layperson taking on the role. This section states the purpose of a specification, what must be communicated, types and the criteria for selecting specification types.
Tender process
After the project details and specifications have been drawn up, you are now prepared for competitive tendering. This process will determine the value of your contract and can be carried out through open or restricted tendering. This section details the tender process from development to implementation. It also provides a step-by-step outline to carrying out a tender.
Contract management
This section offers a comprehensive insight into developing a contract, including procedures, conditions and frameworks. It begins by establishing what a reliable contract is and is followed by key aspects and a step-by-step guide to formulating a good steady contract.
Professional liability exposure
The differences between tort and contract are explored and it's characteristics are discussed. The notion of liability, avoidance and ownership are also studied through various case studies.
